Terms of Service

These Terms of Service (“Terms”) govern your use of services provided by Crystal Gomez Tech (“we,” “our,” “us”). By accessing or using our services, including our website, CRM platform, consulting services, educational programs, or events, you agree to these Terms.

1. Services Provided

Crystal Gomez Tech provides technology solutions and services including:

• CRM subscription access

• Technology consulting

• Digital literacy training

• Educational programs and workshops

• Business events (virtual and in-person)

Services may be delivered online, in person, or through third-party platforms

2. Eligibility

You must be at least 18 years old to use our services unless otherwise approved in writing.

3. Registration & Accounts

  • You may be required to provide accurate and current information to access certain services

  • You are responsible for maintaining the confidentiality of login credentials

  • You are responsible for all activity conducted under your account

We reserve the right to suspend or terminate accounts with inaccurate or unauthorized information.

4. CRM Subscription Services

If you subscribe to the Crystal Gomez Tech CRM Subscription:

  • You are granted access to a cloud-based CRM platform

  • Subscription features and limits vary by plan and are defined in the applicable proposal, invoice, or service agreement

  • The platform is supported by third-party providers

  • Standard onboarding may include account provisioning, access configuration, user assignment, and basic platform orientation

  • Additional implementation, customization, workflow development, automation creation, consulting, integrations, or training services are not included unless expressly outlined in writing

You acknowledge that:

  • Certain features may incur additional usage-based fees, including SMS, email, and phone services

  • Messaging services may require registration, including A2P 10DLC

  • Platform functionality may depend on third-party providers

  • Crystal Gomez Tech is not responsible for third-party outages, limitations, pricing changes, feature modifications, or service changes

Clients are responsible for complying with applicable communication, marketing, privacy, and data protection laws when using the CRM platform and related services.

6. Agency Transfers

If you subscribe to a Crystal Gomez Tech CRM service and wish to transfer your account to another agency or service provider:

  • You may request an account transfer in writing

  • All outstanding balances must be paid before the account is released

  • You retain ownership of your business data within the CRM platform

  • Crystal Gomez Tech will make reasonable efforts to facilitate the transfer process

You acknowledge that:

  • Proprietary agency assets remain the property of Crystal Gomez Tech

  • Proprietary assets may include snapshots, workflows, automations, templates, funnels, websites, custom configurations, onboarding materials, training materials, systems, and processes

  • Proprietary assets are not included in an account transfer unless otherwise agreed in writing

  • Crystal Gomez Tech reserves the right to remove proprietary assets prior to account release

Crystal Gomez Tech is not responsible for the actions, service quality, pricing, support, or configuration changes made by the receiving agency or service provider after transfer.

6. Payment & Fees

  • All fees must be paid as outlined in your invoice or service agreement

  • Subscription services are billed on a recurring basis according to the selected plan

  • Monthly subscriptions are billed on the same calendar day each month

  • Annual subscriptions are billed on the same calendar date each year

All payments are non-refundable unless otherwise agreed in writing.

Failure to maintain valid payment information may result in suspension of services. A reactivation fee may apply.

7. Refund & Cancellation Policy

We understand that schedules may change. Our policy is as follows:

a. Consulting & Training Sessions

  • Rescheduling: Allowed with at least 24 hours’ notice

  • Late Cancellations: If canceled with less than 24 hours’ notice, the session may be forfeited and non-refundable.

b. Programs & Courses

  • Before Start Date: Partial refunds may be available if canceled at least 7 days prior

  • After Start Date: No refunds once the program begins

  • Credits: May be issued at our discretion

c. Events & Workshops

  • Registrations: Non-refundable unless canceled by us

  • Transfers: Allowed with at least 48 hours’ written notice

d. CRM Subscription

  • Monthly subscriptions may be canceled prior to the next billing cycle

  • Annual subscriptions remain active through the full billing term

e. Our Right to Cancel

We reserve the right to cancel or reschedule services. In such cases, you may receive a rescheduled date, credit, or refund.

8. Acceptable Use

You agree to use our services only for lawful and appropriate purposes.

You may not:

  • Resell or redistribute access to the CRM platform

  • Use services for unlawful, deceptive, or abusive activities

  • Violate communication or data protection laws

We reserve the right to suspend or terminate access for violations.

9. Client Responsibilities (CRM Use)

If using the CRM platform, you are responsible for:

  • Managing your data and contacts

  • Obtaining proper consent before sending communications

  • Compliance with applicable privacy and communication laws

Crystal Gomez Tech does not control how you use your data.

10. Use of Materials

All materials, training content, and digital resources are provided for your personal or business use only.

You may not reproduce, distribute, or resell materials without written permission.

11. Intellectual Property

All content, materials, branding, and systems provided by Crystal Gomez Tech remain our intellectual property unless otherwise agreed in writing.

12. Data & Privacy

Your use of our services is subject to our Privacy Policy.

We implement reasonable safeguards but cannot guarantee complete security. The platform may rely on third-party providers for service delivery.

13. Limitation of Liability

Services are provided “as is.” We do not guarantee specific outcomes.

To the fullest extent permitted by law, Crystal Gomez Tech is not liable for indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunities.

14. Third-Party Services

Our services may include integrations or reliance on third-party platforms.

We are not responsible for:

  • Third-party outages or service interruptions

  • Changes to third-party features or pricing

  • Data handling by third-party providers

15. Termination

We reserve the right to suspend or terminate services for:

• Non-payment

• Violation of these Terms

• Misuse of services

• Legal or compliance concerns

16. Governing Law

These Terms are governed by the laws of the State of Texas.

17. Updates to Terms

We may update these Terms from time to time. Material changes will be posted on our website and may be communicated through email or other reasonable means.

The Effective Date at the top of these Terms will indicate when the most recent changes were made.

Continued use of our services following the Effective Date of any updates constitutes acceptance of the revised Terms.
